what's illegal at work?

Well I'm currently really pissed off. I just think it's stupid when I got "spazzed" at from my shift-leader at work saying how it's unacceptable to say i'm sick and how i can't come in last minute. blah blah blah. okay but the thing is, i was ON CALL, meaning that if someone else can't make it to their original shift because they are sick, i have to come in. So i got told that it was unacceptable and how i have to explain to my manager what i did wrong and whatnot. So here's my final question, isn't it illegal for my manager to put me "ON CALL" without paying me even if i didn't get called in for work? i just think it's really stupid that i have to make sure i can't make plans on my on call shift and getting my plans ruined just cus i'm on call and i don't even get paid. there's even a new rule at my work. "if you are sick, u MUST provide a doctor's note." i'm thinking of quitting tomorrow cus I can't take it anymore. I'm on call every single friday and i can't make plans before friday because i have to call in 3 hours before my shift on friday and ask if i need to come in or not. *sigh*

Re: what's illegal at work?

My b/f is often on-call, but he is payed a "premium" for it. They pay him for like one hour just to be on-call, and then they pay him overtime wages if he does in fact get called in. It might just be that he has a great employer though...

Re: what's illegal at work?

No, you can actually have 'on call' shifts where you do have to call in to see if they need you, and they don't need to pay you for the time that is 'on call.' It's not considered illegal, and yes, if you cannot make it, then you have to call in sick, b/c it's technically a scheduled shift.

The purpose of an 'on call' shift is usually b/c if the store is busy and they need an extra person, they can call that individual in....or yes, if someone calls in sick for work, it's kinda like a backup.

I'm not denying that it totally sucks that you cannot make plans until the last minute, but unfortunately, that's how retail works (i'm assuming it's some sort of retail job?). The good thing is that you have a 3hr grace before hand, so why don't you let your friends know that you have 'tentative' plans, but that if you have to work, you'll have to cancel??

I had many 'on call' shifts before, and yes it totally sucked, but i had to bite the bullet and go through with it. I'd often make plans with friends and then reschedule, or go out afterwards anyways.

The only thing I can suggest is possibly switching shifts with someone who has a scheduled shift, if you want the $$ that is.....or see if someone else wants the 'on call' shift.

As for the rule of the doctor's note.....i'm not too sure about the legalities around that....they may just be saying that b/c people might be constantly calling in sick, and they may be finding that it's becoming hard to have people show up for shifts....i'm not too sure

Re: what's illegal at work?

it totally irks me when people call in sick and you KNOW they aren't sick. kinda convenient to call in sick on a nice, sunny summer day...

Re: what's illegal at work?

I used to work at the Hyatt and sometimes i'd be "on call" but they had no problem if i couldn't come in becuase they could easilly find someone else to cover a shift as we were payed well and got at least $100 in tips a night. If you are sick then it's good to give them at least 3 hours notice so they can find a replacement.

Re: what's illegal at work?

that happened to my friend and he ended up quitting. i recommend you ditch that job. if they are treating so unfair and not paying you properly, its not worth it. there's so many jobs out there
