17 hour work days?

Is that legal? Future Shop is making my boyfriend work 17 hours on boxing day, 62 hours during that week in total without overtime. Apparently it has something to do with him making commission, but to me commission does not count as overtime, it's part of his job.

His boss said it's legal, but I'd love it if someone could direct me to a site or something that could tell me more about it.

He's all strung out, they've been making him work full time even though he's only marked his schedule for part time and if he says he can't work, they make him feel guilty. His sister just came back from Engand for 2 weeks but he's had zero time with her because of that stupid store.

Can always quit and find a better job. It's supposedly easier to find a job if you're qualified out there. Everyone's hiring.

if your bf works at a set salary instead of being paid by hours..
then it is legal i believe. (i could be wrong)

cuz the place where i work.. managers.. consultants
get a set monthly salary.. and they ALWAYS work long hrs with no overtime pay.
and i work for a big company..

so yeaaa..

i work for a big company too.

i feel sorry for you bf.

Best place to check is Employment Standards. You can reach them by calling 1 800 663-3316 (toll-free in British Columbia). Under normal circumstances (normal worker) he would be paid time and a-half for anything over 8 hours to 12 hours and double time for anything over 12 hours. This is unless he has agreed to a longer, averaged schedule (ie. average 40 hours per week, 10 hrs per day 4 days per week, or the like). Managers are classified differently, and I believe ilovepink is correct, extra hours are not paid (although they may be able to bank it - depends on their contract, I think).

yup its true, i'm a consultant, and i work long days sometimes, esp when i'm out of town (12 hrs+ sometimes). But what we do is bank that time that we work as overtime to paid vacation days.

I looked up the ESA, apparently if you are on commission it is quite legal to have you working overtime without paying you for it because they count your commission as overtime. Of course they fail to tell you this when you sign up for the job.

Personally, I think that is a load of bull. He will be quitting.

Future Shop is a bad bad place. I can understand a few hours overtime, but they have him working 62 hours next week. He's only supposed to be part time.
